Creator Content Release Form

This Content Creator License (“License”) relates to any photographs, videos, comments, and other content that: (a) you post or have posted to Instagram, Facebook, Pinterest, YouTube, TikTok, X, or any other social media platform (now known or developed in the future) tagging or mentioning Studio McGee or any of its accounts in an identifiable way (for example, by using #StudioMcGee or @mcgeeandco); or (b) is listed in or otherwise covered by an email request, social media post, direct message, online form, or other communication that refers or links to this License (each, a “Content Request”) or your response to a Content Request. All such content is referred to herein as the “Licensed Content.”

By responding “#YesStudioMcGee” to any Content Request, or by indicating your assent to this License in any other manner, you grant certain permissions to Studio McGee and provide certain representations, warranties, releases, and consents for Studio McGee to rely on with respect to the Licensed Content, all as set forth in this License.

You hereby grant Studio McGee, Inc. and its affiliates (including but not limited to McGee & Co., Inc.) and its and their successors, assigns, and licensees (individually and collectively, “Studio McGee”) a non-exclusive, perpetual, royalty-free, irrevocable, transferrable, sublicensable (through multiple tiers), worldwide right and license to reproduce, distribute, publish, translate, edit, prepare derivative works based on, publicly perform, publicly display, and otherwise use the Licensed Content, for all or any purposes whatsoever, in any form, media, or technology now known or hereafter developed, including but not limited to the Internet (such as social media channels, blogs, and websites), mobile applications, gaming platforms, and press releases. You also hereby grant Studio McGee the right (but Studio McGee has no obligation) to use your name, alter-ego (such as a social media handle), image, and likeness to identify you as the source of the Licensed Content.

You acknowledge that Studio McGee’s distribution, display, or other use of the Licensed Content (if any) is entirely at Studio McGee’s discretion and may stop at any time.

You hereby represent and warrant that: (i) you exclusively own all rights, title, and interests in and to the Licensed Content (including all copyrights therein) and have all necessary rights and authority to grant Studio McGee the rights granted herein; (ii) you have obtained or will timely obtain any necessary consents, waivers, and other permissions from any individuals depicted or named in the Licensed Content for Studio McGee to fully exercise its rights under this License; (iii) the Licensed Content does not infringe, misappropriate, or violate, and is not otherwise covered by or subject to, any third party’s intellectual property rights or rights of publicity or privacy, nor does it violate any applicable law or regulation, and (iv) Studio McGee’s distribution, display, or other use of the Licensed Content (whether or not for commercial purposes) will not infringe any third party’s intellectual property rights or rights of publicity or privacy or violate any applicable law or regulation.

You hereby release, discharge, and agree to indemnify and hold harmless Studio McGee and its officers, directors, employees, and agents from and against all actions, claims, damages, liabilities, costs and expenses arising out of Studio McGee’s distribution, display, or other use of the Licensed Content.

By permitting Studio McGee to use the Licensed Content, you also consent to Studio McGee processing any personal data contained within it as well as your social media handle. Please review our Privacy Policy to learn about how Studio McGee may process your personal information and your options for withdrawing consent for such processing.

This License and your agreement to it will continue to be binding even if you delete your “#YesStudioMcGee” approval post or the Licensed Content from any social media platform.

This License will be governed by and interpreted pursuant to the laws of the State of Utah, notwithstanding any conflicts of law. You consent to the jurisdiction of and venue in the state and federal courts located in Utah in connection with any dispute between you and Studio McGee.
